Clubhouse Contract

I understand and agree to all the following in reserving and using the Knollwood Lakes Amenity Areas.

Conditions for Knollwood Lakes HOA Clubhouse Rental

  1. 1. Clubhouse may be rented by Homeowners/Members of Knollwood Lakes HOA ONLY.
  2. 2. No one other than the Homeowner renting the facility may execute this Contract.
  3. 3. The Member renting the facility MUST be current with all Annual and Special Assessments with NO outstanding liens or Covenant Violations.
  4. 4. Swimming Pool use requires additional lifeguards and fees and is contracted separately.
  5. 5. The use of Indoor/Outdoor Heaters of any type, Candles, BBQ Grills, Smoke, Cauldrons, Fire Works, Fog Machines or Pyrotechnics inside the Clubhouse or on the Outdoor Deck is STRICTLY PROHIBITED.
  6. 6. If this contract is breached in anv way. but specifically involving SAFETY or DAMAGE to the facility, the member and guests will be requested to vacate the facility. the contract will be terminated, and the member renting will forfeit ALL the applied payments made to rent the facility.
  7. 7. If condition six (6) above becomes necessary, all will be requested to vacate the premises at ONCE. If this is  not followed, GCPD will be summoned to escort the Renters from the Clubhouse and Pool areas. Failure to leave the facilities as requested places the Renter(s) in an illegal trespass situation. If this situation occurs, this may result in a permanent prohibition of that Member from renting the facility at any future date.
  8. 8. If a special request or condition does not appear as a part of this contract in writing, then it is considered not agreed to by the Community Manager or Board of Directors.

You must agree to all of the following conditions to be permitted to rent the clubhouse.

I agree to pay according to the deposit and security fee schedule.
The Security Deposit will be refunded after the inspection has determined that no damages have occurred and that all conditions of this agreement have been met, a minimum of 7 days after event. If damage is found in excess of the Security Deposit, you will be billed for the additional amount after your deposit has been applied to the bill. Cancellation of a Clubhouse reservation less than 14 days prior to the scheduled function will result in an assessment of a $50.00 penalty. Cancellation of a Clubhouse reservation less than 5 days prior to the scheduled date of the function will result in a $100.00 penalty.
I agree to remove all trash and place it in the trash containers outside of the Clubhouse, remove all items from the Refrigerator (ensure Ice Maker is turned off) and wipe up any spills from the floor or on the furniture prior to vacating the premises. The Resident Homeowner responsible for scheduling the use of the Clubhouse or the qualified non-resident renter must be present at all times during set-up and while the scheduled function is in progress and is responsible for supervising anyone under the age of 21 years. Failure to clear out of the clubhouse by 1:30am on the evening of my rental will result in a $25.00 charge. If the clubhouse is still not in rentable condition by 10:00 a.m. the following day, I will be charged $150.00.
Alcohol may only be consumed by those residents and their guests who would otherwise be a lawful consumer under applicable City, Gwinnett County and Georgia state laws. The present minimum age is 21. By allowing the private consumption of alcoholic beverages at Clubhouse functions by Homeowners and their Guests. Knollwood Lakes Homeowners Association, Inc. does not assume liability in any form, implied or otherwise, that may arise as a result of said consumption. The selling of alcohol is strictly prohibited. I further agree to complete a Host Liquor Liability Waiver Form and to abide by the restrictions contained therein which is attached to this contract.
Unless other arrangements are specifically made and agreed to as part of this contract, hours for the Clubhouse usage are 10:00am to 12:00am, Sunday through Thursday, and 10:00am to 1:00am Friday and Saturday. Failure to abide by these hours may result in a penalty of up to the deposit fee and a suspension of the use of the Association's Clubhouse facilities. The Clubhouse must be locked with the alarm on and lights turned off prior to vacating the premises. Additionally, the thermostats must be set to the required temperature prior to vacating the premises- Rental of the Clubhouse does not include the use of the pool, pool area or the surrounding common grounds. Thermostat Controls and Security/Alarm Rules: Summer - Set no lower than 70 degrees during use; Set at 80 degrees when closing up. Winter: - Set no higher than 72 degrees during use; Set at 60 degrees when closing up. A fee of $50.00 for each floor will be charged if the thermostats are not properly set when vacating the Clubhouse.
Drapes in the Clubhouse are to be left OPEN for the duration of your rental event.
I understand that the Pool is not a part of this contact. Should I wish to use the pool, I will contact the Community Manager who will provide contact information to the Pool Committee. I understand that the pool will not be closed to the membership should I also request to use the pool as a part of my agreement. To use the pool I understand there are additional requirements and fees to include the Pool and surrounding deck area and additional Lifeguards as a part of this agreement. Special bracelets must be worn by those using the pool as a part of a rental contract. I also understand that any unauthorized swimming carries a penalty of $200.00. The upper level deck is available for use to those renting the main floor of the Clubhouse. Prior approval, in writing and detailing the specifics, is required before anything may be attached to the Clubhouse structures.
The Homeowner agrees to indemnify and hold harmless the Association, its Officers and Directors, Agents and Employees from and against any and all claims, liabilities, losses, damages, actions, costs. expenses and demands of any party made against the Association, its Officers and Directors, Agents and Employees arising out of or in connection with any party or event held in the Clubhouse by a Homeowner pursuant to the Rental Contract or otherwise. I understand that the Association reserves the right to enter the Clubhouse and terminate my use thereof should I violate any term(s) hereof or should the conduct of any person using the facility endanger the health, safety or well- being of any person or constitute a threat of damage to any person or property. I understand and agree to all of the above conditions concerning the reservations of and using the Knollwood Lakes Clubhouse and Amenity Areas.

CLUBHOUSE RENTAL PROCEDURE

GENERAL RULES:

  1. Only owners may rent and they are required to sign the Clubhouse Contract Form. Checks must come from the owner.
  2. The owner or designated renter must be present at the walkthrough before the event.
  3. The owner must be in good standing with the community being current with dues and having no unresolved violations.
  4. A rental date must be more than 14 days after the date the request was submitted. An exception to this minimum may be granted by the Clubhouse Manager after a review of all factors affecting availability of the clubhouse on the requested date.

RENTAL PROCEDURE:

Step 1
Consult the Clubhouse Calendar located in the Knollwood Lakes HOA Webpage to verify that your date of interest is available.

Step 2
Fill out the online Clubhouse Contract Form completely and submit. Laura Lazar, Community Manager, will then verify that the requestor is in “good standing” (current with dues and has no unresolved violations). Once verified, the Form is sent to the Clubhouse Manager who logs in the rental information.

Step 3
The Clubhouse Manager (presently Dave Ellefson, 1019 Shady Spring Ct, davelin64@hotmail.com, 470-331-9603) will notify the renter that the rental date has been approved. At that time, arrangements are made for submitting the Security Deposit and Rental checks to the Clubhouse Manager.

Step 4
The Renter submits checks for the rental to the Clubhouse Manager. The Security Deposit check is due immediately as receipt of this check secures your rental date. The Rental check is due a minimum of 30 days prior to the rental date. Both checks are made out to: Knollwood Lakes HOA.
Note: The security deposit check will be returned following your event. If damage, glitter, excessive trash, or poor floor condition is found, some of the security deposit will be used for repairs or cleaning. Payments must be made by check. Checks should be made payable to Knollwood Lakes HOA and must be signed ONLY by the Homeowner in Knollwood Lakes whose name is also on the Contract and who is responsible for the rental. The Rental fee and Security Deposit must be two separate checks. All checks should be submitted to the Clubhouse Manager.

Step 5
If a preview of the clubhouse is needed, contact the Clubhouse Manager to set up a walkthrough.

Step 6
During the week prior to your rental, you will be contacted by the Clubhouse Manager or his
designee to set up a walkthough of the clubhouse. During the walkthrough, the entry/security system will be reviewed as well as cleanup expectations. You will receive the entry key card at that time.

Step 7
Following your rental, the Clubhouse Manager or his designee will conduct an inspection of the clubhouse. If any new damage is discovered or if the clubhouse has violations as described in the rental agreement, it will be noted and you will be invited to meet at the clubhouse with the person doing the inspection to review the observed damages/violations. Charges for any damage or violations will be subtracted from the security deposit. The Homeowner Association and IntegrityAMG are not responsible for any problems or conflicts resulting from your use of the facility. (See Agreement/Contract for details.) Cancellation of a clubhouse reservation less than (14) days prior to the scheduled function may result in a $50.00 Handling Fee. Cancellation of a clubhouse reservation less than (5) days prior to
the scheduled date of the event will result in forfeiture of the Rental fee.

NOTE: Set up of the clubhouse is generally not permitted until after 10:00 AM on the day of your
event. Setting up the clubhouse earlier than 10:00 AM needs to be coordinated with the Clubhouse
Manager at the time of the clubhouse walkthrough.
